Provingly S.L. (from now on, “Provingly”), would like to give you some details on how we process the personal data you provide when you interact with us. Therefore, this privacy policy applies to all those who provide or have provided us with personal information by any means, specifically where you see a reference to this policy, including on a form, website, emails, apps, etc.

We have called this document “How we process your data” because it is important for us to make this information as accessible as possible for you but if you prefer more traditional denominations, this document is our company’s Privacy Policy.

The legitimate interest of Provingly for processing your data is based on:

  • Execution of the contract for the provision of our services.

Why will we process your data?

We use the personal data that you provide us via the various forms enabled for this purpose to manage the products and services that we offer here at Provingly. This data allows us to maintain the relationship with users, as well as to manage, administer, provide and enhance our services, which we would not be able to provide without this data. Therefore, if you do not want us to process your data, you will not be able to use our services.

Similarly, if there is a contractual relationship, we will send you information about our products and services. If you do not want to receive any information about our services or at some point you wish to stop receiving it, please inform us by sending an email to info@provingly.io or by mail to the registered office at the address indicated above.

In order to offer products and services according to your interests and to improve your user experience, etc., we will prepare a “user profile” based on the information you provide us. Thus, based on this information, we can make automated decisions to improve the service we offer, making buying recommendations or sending marketing information related to your interests. You can always oppose this automated processing in the corresponding section of your profile.

Why do we use your personal data?

The legal basis of the processing of your data will depend on your role and the way you interact with us, either as a customer, a user of our services, a person providing services to a supplier or customer, etc. In any of these cases:

Who do we disclose your personal data to?

We do not assign your data to anybody. We will only disclose data when we are required to do so by law or you have previously given us your express permission.

In order to provide the services in an adequate manner, we need to work with companies that process your data on our behalf (hosting providers, email servers etc.), as part of the provision of a service that we have contracted, with whom we sign the relevant data processor agreements and from whom we demand compliance with regulations on personal data.

How long will we keep your data?

Regarding each processing task for which you have given us your consent, we will keep the data for as long as necessary to guarantee the provision of the service and comply with our legal obligations.

The personal data provided will be kept as long as you maintain a relationship with us and remain subscribed to our website and/or newsletter; until you request your withdrawal and deletion of the data; for a period of 4 years from the last confirmation of interest; etc.).

You may request the cancellation of your data and/or subscription whenever you consider appropriate.

After cancelling your subscription to the newsletter, we will block your data and retain it only in the event that the applicable regulations require us to do so.

How do we safeguard your data?

That is why we maintain personal data protection security levels in accordance with General of Data Protection Regulation (EU) 2016/679, of 27 April, (GDPR) and Spanish Organic Law 3/2018, of 5 December, on Data Protection and the guarantee of digital rights, and we have established all the technical means at our disposal to prevent the loss, misuse, alteration, unauthorised access and theft of the data that you have provided us. However, users should be aware that Internet security measures are not 100% fool proof.

We once again remind you that you can exercise your rights of access, rectification, erasure and opposition as well as restriction of processing and portability of data at either of the addresses shown above or by email to info@provingly.io, enclosing photocopy of your identity document and indicating what action you require us to perform.

Access, Correction and Deletion

You can consult your personal data through any of the contact means provided.

Opposition

You may oppose the processing of your data in certain circumstances and for reasons related to your specific situation. Provingly will stop processing the data, except where legitimate purposes prevail, or to exercise or defend against possible claims, or to comply with our legal obligations.

Restriction of processing

In certain circumstances data subjects may request the limitation of the processing of their data, in which case we will only keep them to comply with our legal obligations.

Portability

If applicable, you may receive, in electronic format, the personal data that you have given us.

Withdrawal of consent

At any time, you may withdraw your given consent without this affecting the lawfulness of processing. If you request the cancellation of your data we will cease processing them, but please bear in mind that in certain cases in which we have the corresponding lawful basis, we will continue to process your data after you have withdrawn your consent and requested the erasure of your data.

We also inform you that you also have the right to lodge a complaint with the Spanish Data Protection Agency – www.aepd.es. In any case, because of our strong commitment to privacy we invite you to directly address us to solve any issue related to your personal data and we will be glad to assist you.

Modification of this Privacy Policy

Provingly reserves the right to modify this policy to adapt it to future legislative or jurisprudential developments, as well as to industry practices, having informed users beforehand via the website. We recommend that you check this website with certain frequency to review the most recent version.

Any modification to the privacy policy will be effective from the moment of its publication. If you do not accept the modifications of the new notice, you can exercise any of your rights or stop using our service. If your continue using our services after the entry into force of these modifications, you accept to be subject to the new privacy policy.

Under no circumstance will these modifications affect the choice expressed with regard to the way in which Provingly can process your personal data. If at any time we wish to use your data in a different way to when it was collected, we will inform you by email, requesting your consent.

Likewise, Provingly reserves the right to terminate the services it provides to any users who do not comply with the legal terms and conditions of use and with the legislation in force.
